なぜ「ビューティはOK、スポーツはダメ」なのか
最高裁が残した「線引きしないという線引き」

米国の最高裁は、ときに何かを決めるのではなく、「決めないこと」を決める。
今回のトランスジェンダーと女子スポーツをめぐる判断は、その典型である。
6月30日、米連邦最高裁は、州がトランスジェンダー女性の女子スポーツ参加を制限することを認めた。ただし、それは「全国共通の基準」を打ち立てる判断ではなかった。
むしろ逆である。最高裁は、統一ルールを司法が作ることを避けた。この一点が重要だ。
判決は、連邦法(Title IX)が、性自認に基づく分類をすべての場面で一律に義務づけるものではない、という整理を示した。
つまり、どの基準を採用するかは、一定程度、州の裁量に委ねられることになる。
ここで起きているのは、「権利の拡張」でも「権利の否定」でもない。制度の統一をあえて避けるという判断である。
結果として、アメリカの女子スポーツは一枚のルールではなくなる。
州によって基準は変わる。出生時の性別を基準にする州もあれば、別の基準を採る州もある。同じ「女子競技」という言葉の中に、複数の制度が同時に存在することになる。
この状態を、最高裁は解消しなかった。むしろ、そのまま残した。なぜか。
スポーツは、本質的に「統一ルール」を必要とする領域である。しかし同時に、アメリカ社会はその統一を一枚岩では受け止められない。権利か、公平か。包摂か、競争の維持か、という問いかけが常にある。
どちらか一方を全米的に固定すれば、必ず別の側が制度からこぼれ落ちる。最高裁はその構造を前にして、「一つにしない」という選択を取ったとも言える。
この問題は、最高裁の判断によって終わったのではない。むしろ形を変えて続くことになった。
ジョージタウン大学の憲法学者ダニエル・ハートマンは、今回の判断について次のように指摘する。
「今回の最高裁判断の本質は、“どちらの側に立つか”ではなく、“全国一律の基準を司法が作らない”という選択にある。これは権利問題の完全な決着ではなく、連邦制の構造的制約を再確認したものだ。結果として、女子スポーツの定義は法廷ではなく州レベルに戻された」
つまり最高裁は、問題を解決するのではなく、分配したのである。
判断を一本化せず、州ごとの裁量に委ねることで、対立そのものを制度の中に残した。その結果、現場ではさらに別の問題が浮かび上がる。州ごとに基準が異なる状況は、すでに競技運営そのものに影響を及ぼしている。
ある州では出生時の性別が基準となり、別の州ではホルモン治療や経過が考慮される。同じ「女子競技」でありながら、参加条件が州境を越えると変わる状況が生まれている。
コーチや学校にとっても事情は単純ではない。どのルールに従うべきかが一義的に定まらないためである。
NCAAの基準に従えば出場できるが、州法に従えば資格を失うというねじれが生じる可能性もある。
元NCAA競技委員のリサ・マクダウェルは次のように述べる。
「スポーツの現場から見れば、問題は理念だけではなく運用だ。州ごとに異なる基準が併存する状況では、“女子カテゴリー”はもはや単一の制度ではない。選手も学校も、どのルールが適用されるのかを事前に確定する必要がある。これは競技の公平性だけでなく、制度の予測可能性の問題になっている」
ここで浮かび上がるのは、価値観の対立だけではない。制度そのものの分裂である。興味深いのは、この構図が政治の側の言葉と重なる部分である。
ドナルド・トランプ大統領は、女子スポーツの問題を繰り返し取り上げてきた。その際、ビューティーコンテストとの対比を持ち出すことがある。
外見の評価は文化の領域であり、身体能力の競争はルールの領域である。この区別は、学術的には単純化されている。しかし政治的には強いメッセージを持つ。
今回の最高裁判断は、その区別を明示的に採用したわけではない。しかし、「線引きを一本化しない」という点では、結果として同じ問題意識に触れている。
つまり、司法もまた、政治と同じ問題に直面している。一つの基準で社会を統一できないという現実である。
象徴的なのは水泳だ。
ペンシルベニア大学で競泳チームに所属していたトランスジェンダー選手のリア・トーマスは、大学女子競技で全米選手権を制したことで大きな論争を呼んだ。
トーマスの出場は、NCAAのルールに基づくものだったが、「競技の公平性」をめぐる議論は一気に政治問題化した。
女子ロッカールームの使用や、出場資格そのものが州議会レベルの争点へと拡大したのは、その象徴的な帰結である。
トーマスの事例が象徴しているのは、個人の是非だけではない。制度がどこまで一貫性を保てるのかという限界である。
その限界に対して、最高裁は最終回答を示さなかった。代わりに、「各州に委ねる」という形で問題を分散させた。それは解決ではない。むしろ、対立を制度の中に残したまま、新しい形に変換したのである。
だからこの問題は、終わらない。州ごとに異なる形で、繰り返されていくことになる。
そしてその分散こそが、いまのアメリカの姿そのものでもある。
最高裁もまた、万能ではない。

The U.S. Supreme Court sometimes makes a decision not by resolving an issue, but by deciding what it will not decide. The Court’s recent ruling on transgender athletes and women’s sports is a case in point.
On June 30, the Court upheld states’ authority to restrict the participation of transgender women in women’s sports. However, the ruling did not establish a nationwide standard. Instead, the Court avoided creating a uniform rule and left much of the issue to state-level discretion.
The significance of the decision lies not in expanding or limiting rights in a simple way, but in refusing to impose a single national framework. The result is that women’s sports in America may now operate under different rules depending on the state.
Some states may define eligibility primarily through biological sex at birth, while others may consider different factors. The term “women’s sports” itself could come to represent multiple systems rather than one unified category.
This dilemma reflects a deeper conflict in American society: individual rights versus competitive fairness; inclusion versus maintaining a level playing field. The Supreme Court’s choice was essentially to avoid forcing one answer on a divided nation.
The ruling also highlights the gap between legal principles and the practical reality of sports. Coaches, schools, and athletes must navigate conflicting standards depending on where competitions take place.
The political debate has often framed the issue through a similar distinction. President Donald Trump has drawn a distinction between beauty contests and sports, arguing that appearance-based evaluation belongs to culture, while athletic competition depends on rules and physical performance. Although the Court did not adopt this argument directly, its refusal to create one universal standard reflects the same underlying tension.
The controversy surrounding swimmer Lia Thomas, who competed for the University of Pennsylvania’s women’s team and won an NCAA national title, became a symbol of this broader debate. Her case transformed a question about one athlete into a national argument over how women’s categories should be defined.
The Supreme Court did not end the debate. It redistributed the conflict. By sending the issue back to the states, the Court preserved America’s federal structure—but also ensured that the controversy will continue in different forms across the country.
